The New Jersey Appellate Division rejected an employee’s application for unemployment compensation benefits because it found that the employee did not resign from his job for good cause attributable to his employment. Rather, it determined that the employee “impulsively quit” his job and then later attempted to justify his decision by asserting “unsafe working conditions.”
The employer prevailed because it was able to present evidence that another employee safely operated the crane that the employee said was “unsafe”.
This opinion demonstrates the importance of having specific information when challenging an unemployment claim.
