The Equal Employment Opportunity Commission (EEOC) revised its workplace poster to incorporate the changes to the Americans with Disabilities Act (ADA) made by the ADA Amendments Act of 2008, which took effect on January 1, 2009, and to include the new requirements of the Genetic Information Nondiscrimination Act (GINA), which takes effect on November 21, 2009. These new developments in federal anti-discrimination law apply to private employers, state and local governments, educational institutions, employment agencies, and labor organizations.
Employers must take steps to comply with the new posting requirements. The EEOC offers the following three options:
1. Download and print the "EEOC is the Law" poster supplement, available at:
http://www.eeoc.gov/employers/upload/eeoc_gina_supplement.pdf. Post the document alongside either the EEOC’s September 2002 edition of the "EEOC is the Law" poster or the Office of Federal Contract Compliance Program’s (OFCCP’s) August 2008 "EEOC is the Law" poster.
2. Download, print, and post the November 2009 version of the "EEOC is the Law" poster, available at:
http://www.eeoc.gov/employers/upload/eeoc_self_print_poster.pdf.
3. Order a new poster through the EEOC Clearinghouse by submitting a form. Details can be found at the following link:
http://www1.eeoc.gov/employers/poster.cfm.
As of the posting of this alert, the EEOC poster was on backorder. Copies of the new posters will be available in Spanish, Chinese, and Arabic, as well as English, before the GINA statute becomes effective on November 21, 2009.
