Day Pitney's Premier Litigation Defense

Defense of Discrimination,
Wrongful Discharge,
Whistleblower, and Other Claims

Our Employment Litigation practice is one of the most active and highly respected practices in the region and beyond. Since June of 2004, the team has opened more than 250 matters involving whistleblower, discrimination, restrictive covenants and other types of employment-related disputes. We defend our clients before federal and state courts, and often make their case before the Equal Employment Opportunity Commission and state civil rights agencies.

ERISA Litigation

Our Employee Benefits Litigation practice provides representation in employee benefits litigation involving all aspects of ERISA, including early retirement incentive plans, severance pay, the ability to modify plan design, breach of fiduciary duty, ERISA Section 510 discrimination claims, and denial of benefit claims.

Labor Arbitrations

We provide representation to management in labor arbitrations. Each year, we arbitrate more than 100 grievance and interest cases.

Wage & Hour Litigation

We have considerable experience in defending against collective and class actions alleging back wages due for overtime and non-compliance with state labor laws.

Toxic Exposure, OSHA and Workforce Injuries

When faced with mass toxic exposure claims from their employees, our clients count on our unique experience in this area and our skilled products liability defense group to provide multi-disciplinary defense strategies. When serious accidents occur, with our experience in a score of workforce fatality cases, we provide guidance with an integrated defense of OSHA, tort, environmental, and criminal defense attorneys. We also represent the interests of our self-insured clients against employee claims filed in the state Divisions of Workers' Compensation.
